Remote work is no longer the exception in many Portuguese companies, yet its formalisation still fails on the basics — three of them especially common in labour-authority inspections.
Written agreement
The Labour Code requires a specific written remote-work agreement, in the original contract or an addendum. A mention in an internal policy is not enough.
Expense allowance
The law provides for reimbursement of the worker’s additional costs — internet, electricity, equipment. Omitting it is one of the most frequent causes of fines.
Right to disconnect
The company must refrain from contacting workers outside working hours, save for force majeure — and prove it with concrete mechanisms, not just a policy.
